Instabooth Express – Terms & Conditions

These Terms & Conditions (“Agreement”) apply to all bookings and hires of photo booth equipment and services provided by Instabooth Express (Tan Family Trust trading as Instabooth Express) (“Instabooth Express”, “we”, “us”, “our”).

By paying a deposit or confirming a booking, the Client agrees to be bound by this Agreement.

Definitions

Instabooth Express: Tan Family Trust trading as Instabooth Express and its employees and contractors.
Client: The person, organisation, company or other body hiring the goods as specified on the Booking Form.
Event Date: The time and date of the event confirmed by Instabooth Express and noted on the Booking Form.
Booking Form: The form signed by, or on behalf of, the Client and Instabooth Express specifying details of the booking.
Hire Period: The agreed operational time stated in the Booking Confirmation.
Day: A calendar day unless otherwise specified.

1. Booking Confirmation & Payments
1.1 A booking is not confirmed until the Client:
Returns a signed Booking Form;
Pays the required deposit; and
Receives confirmation from Instabooth Express.
1.2 A non-refundable deposit of $100 is payable upon booking.
1.3 The remaining balance must be paid no later than fourteen (14) days prior to the Event Date unless otherwise agreed in writing.
1.4 All payments are non-refundable except as expressly stated in this Agreement.
1.5 Instabooth Express is GST Free.
1.6 Failure to pay the balance by the due date may result in cancellation of the booking and forfeiture of the deposit.
1.7 Additional hire time requested on the day of the event will be charged at $150 per additional hour or part-hour, payable immediately.

2. Hire Period
2.1 The Hire Period begins and ends strictly at the times stated in the Booking Confirmation.
2.2 The full hire fee is payable regardless of:
• Guest participation;
• Interruptions;
• Delays caused by the venue or Client.
2.3 Time lost due to access restrictions, power issues, guest interference or external factors does not extend the Hire Period.
2.4 Unlimited Printing: Where the booking includes “Unlimited Prints”, this means guests may take and print as many individual photo sessions as desired during the Hire Period.“Unlimited Prints” does not include unlimited duplicate copies of the same photo session. Instabooth Express reserves the right to limit excessive reprints of identical images where such printing is deemed unreasonable, abusive, or likely to cause damage, depletion of consumables, or interruption to service.Printing is limited strictly to the duration of the Hire Period and ceases at the conclusion time stated in the Booking Confirmation. Instabooth Express reserves the right to manage print output where necessary to protect equipment integrity and ensure fair usage.

3. Access, Space & Venue Requirements
3.1 The Client must provide:
• Minimum space of 2.5m x 2.5m;
• A flat, stable surface;
• Access to a dedicated 240V power outlet within 5 metres;
• Doorways and access paths at least 80cm wide;
• Adequate weather protection for outdoor events;
• Wi-Fi connection where social media features are requested.
3.2 The Client warrants that the venue power supply is safe, compliant and suitable for commercial equipment use.
3.3 The Client is responsible for all venue charges including parking, access fees and electricity.
3.4 Instabooth Express may refuse setup or cease operation if the environment is unsafe.
3.5 A site inspection may be required and may incur a $50 fee.

4. Technical Issues & External Factors
4.1 Instabooth Express will deliver, install and test equipment prior to the Hire Period.
4.2 Instabooth Express is not liable for interruption, malfunction or reduced performance caused by circumstances beyond reasonable control, including:
• Power outages or surges;
• Venue electrical faults;
• Guest misuse or interference;
• Printer jams due to improper handling;
• Internet/Wi-Fi failure;
• Automatic software updates;
• Environmental conditions (heat, dust, moisture, vibration).
4.3 The Client must notify Instabooth Express immediately if an issue arises.
4.4 Telephone guidance may be provided, however on-site attendance is not guaranteed.
4.5 No refunds, credits, compensation or extensions will be provided for interruptions outside our reasonable control.
4.6 Instabooth Express is not responsible for loss, corruption or failure of digital images or data due to technical malfunction beyond reasonable control.

5. Unattended Hire
5.1 Where the Client elects unattended hire, no Instabooth Express staff will supervise the booth.
5.2 The Client accepts full responsibility for:
• Guest conduct;
• Preventing misuse or tampering;
• Ensuring equipment is not moved.
5.3 The Client acknowledges unattended hire carries increased risk of interruption and accepts this risk.

6. Safety, Conduct & Alcohol
6.1 Instabooth Express reserves the right to refuse service to any person who is intoxicated, aggressive or behaving inappropriately.
6.2 If staff or equipment are threatened, Instabooth Express may cease services immediately without refund.

7. Damage to Equipment
7.1 All equipment remains the property of Instabooth Express.
7.2 From delivery until collection, the Client is fully responsible for any loss, theft or damage caused by:
• The Client;
• Guests;
• Venue staff;
• Contractors;
• Any person attending the event.
7.3 The Client agrees to pay the full cost of repair, replacement loss of job due to booth not being able to be use during it repair or replacement as reasonably determined by Instabooth Express.
7.4 Invoices for repair or replacement are payable within seven (7) days.
7.5 Nothing in this clause excludes rights under the Australian Consumer Law.

8. Social Media & Image Use
8.1 Social media uploads require strong internet signal. Instabooth Express is not responsible for poor venue connectivity.
8.2 Images are typically delivered within 48 hours after the event.
8.3 Unless the Client notifies Instabooth Express in writing prior to the event, the Client grants permission for images to be used for promotional purposes.
8.4 The Client is responsible for informing guests that photography will occur.

9. Changes & Cancellations
9.1 Date change requests must be made at least 30 days prior and are subject to availability.
9.2 Cancellations more than 30 days prior forfeit the deposit but may receive a 6-month credit at our discretion.
9.3 Cancellations within 30 days of the Event Date forfeit all payments made.
9.4 Same-day cancellation or event inability to proceed due to Client circumstances results in forfeiture of 50% of total booking fee.
9.5 Instabooth Express may cancel due to unforeseen circumstances beyond reasonable control. Liability is limited to refunding payments received.

10. Weather (Outdoor Events)
10.1 The Client must provide adequate shelter.
10.2 Instabooth Express may refuse setup or cease operation if weather poses risk.
10.3 No refund will be provided where service is suspended for safety reasons.

11. Force Majeure
11.1Instabooth Express is not liable for failure to perform due to events beyond reasonable control including natural disasters, government restrictions, power failures or road closures.

12. Limitation of Liability (Australian Consumer Law)
12.1 Nothing in this Agreement excludes, restricts or modifies rights under the Australian Consumer Law (ACL).
12.2 To the extent permitted by section 64A of the ACL:
Liability for breach of any non-excludable guarantee is limited to resupplying the services or paying the cost of resupply.
12.3 vInstabooth Express is not liable for indirect, consequential or economic loss.
12.4 Total aggregate liability shall not exceed the total hire fee paid.

13. Indemnity
13.1 The Client indemnifies and holds harmless Instabooth Express, its owners, employees and contractors from any claims, losses or liabilities arising from:
13.2 Injury caused by misuse of equipment;
13.3 Damage to venue property caused by guests;
13.4 Breach of this Agreement by the Client.
13.5 This clause survives termination.

14. General
14.1 This Agreement is governed by the laws of Western Australia.
14.2 Any dispute is subject to the jurisdiction of WA courts.
14.3 If any provision is held invalid, the remainder of the Agreement continues in full force.

15. Variation of Terms
15.1 Instabooth Express may amend these Terms & Conditions at any time.
15.2 Updated Terms apply to new bookings made after publication.
15.3 The Terms in effect at the time of booking confirmation apply to that booking unless otherwise agreed in writing.
